Welcome to the marvelous digital universe meticulously crafted for you by NORHEN LIMITED (hereinafter referred to as "we," "us," "the Company," or "the Guardians of the World"). Before we embark on this exciting journey together, we invite you to take a moment to carefully read this "Our Game World Covenant" (hereinafter referred to as "this Covenant").

This document is not a cold, rigid legal text, but a sacred pact between us and you—each of our cherished players (hereinafter referred to as "you," "the player," or "the Adventurer"). It establishes the fundamental principles for you to explore, create, interact, and have fun in our game world, and it also clarifies our responsibilities and rights as the Guardians of the World. By downloading, installing, accessing, or in any way using our game and related services (collectively, "our Services"), you signify that you have fully understood and unconditionally agree to be bound by all terms of this Covenant.

If you disagree with any part of this Covenant, or if you have not reached the legal age of majority in your jurisdiction and have not obtained the consent of a parent or legal guardian, then we must regrettably inform you that you may need to pause your adventure until these conditions are met.

We believe that a harmonious, fair, and creative gaming environment requires the collective effort of every member to maintain. This Covenant is the cornerstone upon which we will build and protect this wonderful world together.

Chapter One: Your Adventure Pass - License to Use

1.1 Grant of License

We grant you a personal, limited, non-transferable, non-exclusive, revocable "Adventure Pass." This pass permits you, in compliance with this Covenant, to install and run our game and access our Services on your personal device for your personal, non-commercial entertainment purposes. Think of it as a ticket to a fantastic theme park; it belongs to you personally for enjoying the park's attractions, but you cannot copy the ticket, sell it to others, or attempt to modify the rides.

1.2 License Restrictions - Things You Shall Not Do

To protect the integrity of our world and the experience of all Adventurers, you agree that you will not, under any circumstances, engage in the following activities:

Commercially exploit our Services or any part thereof in any form, including but not limited to offering our game service at internet cafes, computer gaming centers, or other commercial venues; or using our Services to conduct advertising, solicitation, or transmission of any commercial advertisements.

Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for our game software; or copy, modify, translate, adapt, or create derivative works of our Services. This is equivalent to attempting to steal the blueprints and magic formulas of our world, which is strictly forbidden.

Use any unauthorized third-party software, bots, crawlers, or tools to intercept, "mine," or otherwise collect information from or through our Services.

Sell, rent, lease, lend, gift, trade, or otherwise transfer your game account or any access rights associated with it. Your Adventurer identity is unique, recording your honor and footsteps, and cannot be shared with others.

Take any action that may interfere with, disrupt, or impose an unreasonable burden on our servers, networks, or other players' devices, such as launching a Denial-of-Service (DDoS) attack.

Attempt to bypass any technical protection measures we have implemented to control access to the Services.

Violating any of the above restrictions will be considered a serious breach of this Covenant. We reserve the right to immediately terminate your "Adventure Pass" and may pursue legal action against you.

Chapter Two: Your Adventurer's Profile - Account Creation and Security

2.1 Establishing Your Account

To fully experience our game world, you may need to create a personal account (your "Adventurer's Profile"). During this process, you pledge to provide true, accurate, complete, and current personal information. Creating an account with false information or impersonating someone else is not only disrespectful to the community but may also lead to the permanent suspension of your account.

2.2 Safeguarding Your Profile

Your account name and password are the sole keys to our world. You are fully responsible for safeguarding these keys. Please be sure to:

Create a strong password using a complex combination of letters, numbers, and symbols, and change it regularly.

Keep it confidential. Never share your password with anyone, not even your closest friends or family. Our staff will never ask you for your password under any circumstances.

Beware of phishing. Be highly vigilant of any emails or links claiming to be from us but asking for your account information. Please always contact us through official channels.

2.3 Unauthorized Use

If you discover or suspect that your account has been used by an unauthorized person or that any security breach has occurred, you must immediately notify us via our official contact email: [email protected]. While we will do our best to assist you, we cannot be held liable for any loss resulting from your failure to properly secure your account information.

2.4 Account Ownership

You understand and agree that you have the right to use your account, not to own it. The account and all its contents, including your game progress, acquired items, and achievements, are part of our Services. We reserve the right to manage, regulate, and (in certain circumstances) terminate any account in accordance with the provisions of this Covenant.

Chapter Three: Code of Conduct for Citizens of the Game World

We are committed to building a positive, inclusive, and fun community. Every Adventurer is a citizen of this world, and your words and actions collectively shape our world's culture and atmosphere. Therefore, we require you to strictly adhere to the following code of conduct while enjoying the game:

3.1 Respect and Goodwill - The Foundation of Communication

You must use civil language. The use of any form of abusive, defamatory, obscene, racist, sexist, hateful, or any other language that may offend others is prohibited. Let's fill the game world with kindness and encouragement.

Harassment is forbidden. You are prohibited from engaging in persistent, unwelcome harassment, bullying, threatening, or "doxxing" of other players. Games are for bringing joy, not fear and anxiety.

You must respect privacy. You are prohibited from posting or disseminating any other player's private information, such as real names, addresses, or emails.

Impersonation is not allowed. You are prohibited from impersonating other players, celebrities, or our staff.

3.2 The Spirit of Fair Play - Maintaining Game Balance

We believe that true fun comes from challenge and fair competition. Any act that undermines the fairness of the game is a betrayal of all honest players.

Cheating is prohibited. The use of any cheating programs, hacks, automation scripts (bots), or any other unauthorized third-party software to modify the game experience or gain an unfair advantage is strictly forbidden.

Exploiting bugs is forbidden. You are strictly prohibited from exploiting unforeseen errors, bugs, or flaws in the game design for your own benefit. If you discover a bug, we encourage you, as a responsible citizen, to report it to us through official channels. We would be very grateful.

Improper trading is prohibited. You are strictly forbidden from using real-world money or goods to trade any in-game content, including accounts, game progress, or game items, outside of the game. Such activities are highly susceptible to fraud and disrupt the balance of the game economy.

Malicious gameplay is forbidden. You are prohibited from intentionally using game mechanics to harm other players, such as malicious teaming, passive play, or obstructing other players' normal gameplay.

3.3 Protecting Our World - A Shared Responsibility

All your actions must comply with all applicable laws and regulations in your jurisdiction and in the jurisdiction where our company is located. You are prohibited from using our Services to engage in any illegal activities, including but not limited to money laundering, financing terrorism, or disseminating illegal information.

Your content must be wholesome. Any content you upload or share (such as avatars, nicknames, chat messages) must not contain illegal, infringing, pornographic, violent, or any other objectionable elements.

We have a dedicated team to monitor in-game behavior. For violations of the above code of conduct, we will take measures based on the severity of the offense, including but not limited to: issuing a warning, temporarily muting, temporarily suspending the account, or permanently suspending the account, without prior notice. Our judgment will be final.

Chapter Four: Acquiring Wondrous Items & Boosts - Value-Added Services

In our game world, you can progress, unlock new content, and earn achievements through your skill and effort. At the same time, to provide more options for Adventurers who wish to accelerate their progress or personalize their experience, we also offer certain value-added services.

4.1 The Nature of In-Game Items

Our game may contain certain "in-game resources," "digital collectibles," "special use rights," or "boost effects" (collectively, "In-Game Items") that you can obtain through specific means. These items are designed to enhance your gaming experience, for example, by providing unique visual appearances, unlocking convenient features, or offering temporary gameplay advantages.

4.2 Methods of Acquisition

You can obtain these In-Game Items through two main methods:

You can earn them through gameplay, such as by completing quests, reaching achievements, or participating in events, as a reward for your efforts.

You may also choose to use legal tender (such as USD, EUR, etc.) to directly purchase a license to use certain In-Game Items.

4.3 Important Legal Notice

When you purchase In-Game Items, you must understand and agree to the following points:

You are acquiring a limited use right. Your purchase grants you a limited, personal, non-transferable license to use the item within the game. You do not "own" the item itself.

All In-Game Items have no real-world value. All In-Game Items, regardless of how they are obtained, have no real-world economic value. They cannot be exchanged for legal tender, goods, or any other items of monetary value. They are part of the entertainment service we provide, not a financial asset or investment.

They are non-transferable. Unless an in-game mechanism is explicitly provided and permitted by us, you may not sell, trade, or transfer any In-Game Items between players. Any such transactions conducted outside of the game platform are strictly prohibited and are not protected by us.

We reserve the right to change the price, availability, and attributes of In-Game Items at any time without notice.

All sales are final. Given the nature of digital items, all transactions for value-added services are final, and we generally do not provide refunds. Unless otherwise mandated by applicable law (such as consumer protection laws), any refund request will be at our sole discretion.

4.4 Payment Processing

All payment transactions will be processed through the Apple App Store, Google Play Store, or other third-party payment platforms designated by us. You must comply with the payment terms and policies of these platforms. We do not directly process your payment information (such as credit card numbers).

Chapter Five: The Creative Spark of Our World - Intellectual Property

5.1 Our Creations

Our Services are a complex creative work, containing the countless days and nights of our team's effort. Therefore, with the exception of your personal data and your User-Generated Content (see below), all content within our Services, including but not limited to:

All code of the game software;

All text, stories, character names, and locations;

All artwork, images, animations, visual effects, and character designs;

All sound effects, music, and dialogue;

All trademarks, logos, and brand identifiers;

The design and concept of In-Game Items;

And the overall look and feel resulting from the combination of all the above content.

All rights, title, and interest (including but not limited to all copyrights, trademarks, patents, trade secrets, and other intellectual property rights) are exclusively owned by NORHEN LIMITED or its licensors. This Covenant grants you only a license to use our Services strictly in accordance with its terms, not a transfer of any ownership.

5.2 Your Creations - User-Generated Content (UGC)

We greatly encourage and cherish your creativity! You may create or upload your own content in the game, such as custom avatars, guild emblems, map designs, or comments and suggestions posted via the chat function (collectively, "User-Generated Content" or "UGC").

You retain ownership. For your original UGC, you retain its original intellectual property rights. We do not claim ownership of your personal creativity.

You grant us a license. However, to allow your UGC to be displayed in our game world, seen by other players, and to enable us to operate and promote our Services, when you submit, upload, or create any UGC through our Services, you grant NORHEN LIMITED a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable right and license. This license allows us to: use, host, store, reproduce, modify, adapt, translate, create derivative works of; and publicly perform, publicly display, distribute, broadcast, and communicate your UGC in any manner now known or hereafter developed. This may sound broad, but it is a necessary legal step to ensure we can legally use your wonderful creations both within and outside the game (for example, in promotions on social media). For instance, we need this license to display the guild emblem you designed to all members of your guild.

You provide a warranty. You warrant that any UGC you submit is your original work, or you have obtained all necessary rights and licenses to submit the content, and that its content does not infringe on any third-party rights (such as copyright, trademark, privacy rights, etc.) or violate any provision of this Covenant. You agree to indemnify us for any third-party claims arising from your UGC.

We reserve certain rights. We have no obligation to monitor or review all UGC, but we reserve the right (but not the obligation) to remove, edit, or disable any UGC that we, in our sole discretion, deem to be in violation of this Covenant or otherwise objectionable, without notice.

Chapter Six: The End of the Journey - Suspension and Termination of the Covenant

6.1 Termination Initiated by You

You may choose to end your adventure at any time. You simply need to stop using our Services and uninstall our game from your device. If you wish to delete your account, you may submit a request according to the instructions provided in-game or by contacting our support email at [email protected].

6.2 Suspension or Termination Initiated by Us

We hope every Adventurer will remain in our world forever, but to maintain the health and safety of the entire community, we reserve the right, in our sole discretion, to suspend (temporarily) or terminate (permanently) your access to our Services without prior notice under the following circumstances:

You are in material or repeated breach of any term of this Covenant.

We have reason to believe you have engaged in or are engaging in any illegal or fraudulent activities.

Your actions have caused harm or potential risk to other players or our Services.

As required by law enforcement or government agencies.

Your account has been inactive for an extended period (typically 180 consecutive days or more).

We decide to discontinue the operation of the game or service.

6.3 Consequences of Termination

Once your account is terminated, whether by you or by us:

Your "Adventure Pass" will immediately become void, and you will no longer be able to access your account and our Services.

All data in your account, including game progress, levels, achievements, and all In-Game Items you have acquired (whether by earning or purchasing), will be permanently deleted or become inaccessible.

You will not receive any form of compensation, refund, or reimbursement for these losses.

Those provisions of this Covenant that by their nature should survive termination (such as Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, etc.) will continue in full force and effect.

Chapter Seven: The Unknown Territories of Adventure - Disclaimers and Limitation of Liability

7.1 Provided "As Is"

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to:

That the Services will be uninterrupted, error-free, free of viruses, or other harmful components.

That the Services will meet all of your expectations and requirements.

That any defects in the Services will be corrected.

We strive to provide a stable and enjoyable experience, but the complexity of the digital world means we cannot promise perfection.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall NORHEN LIMITED, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use our Services. These damages include, but are not limited to, loss of profits, loss of data, loss of goodwill, work stoppage, device failure, or any other intangible losses.

In any case, our total cumulative liability to you shall not exceed the total amount you have paid to us through our Services in the six (6) months immediately preceding the event giving rise to the claim. If you have not paid us any fees, your sole and exclusive remedy is to discontinue using our Services.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain types of damages, so some or all of the above limitations may not apply to you.

Chapter Eight: The Peaceful Path to Resolving Disagreements

8.1 Informal Negotiation

We firmly believe that the vast majority of disagreements can be resolved through friendly communication. Before filing any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting [email protected]. Please describe your concerns in detail in the email. We will make our best effort to communicate with you to resolve the matter within thirty (30) business days of receiving your email.

8.2 Governing Law and Jurisdiction

This Covenant and any dispute between you and NORHEN LIMITED shall be governed by and construed in accordance with the laws of Northern Ireland, without regard to its conflict of law principles.

You agree that any legal action or proceeding that cannot be resolved through informal negotiation shall be submitted to the exclusive jurisdiction of the competent courts located in Northern Ireland. You hereby consent to and waive any objection to the personal jurisdiction and venue of such courts.

Chapter Nine: The Foundation of the Covenant - General Provisions

9.1 Updates to the Covenant

The game world is constantly evolving, and this Covenant may need to be updated accordingly. We reserve the right to modify this Covenant at any time. For any material changes, we will notify you through reasonable means, such as an in-game announcement, push notification, or an email to your registered email address. The updated Covenant will become effective upon posting. Your continued use of our Services after the changes take effect signifies your acceptance of the new terms. We recommend that you review this Covenant periodically to ensure you are aware of the latest version.

9.2 Severability

If any provision of this Covenant is held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, that provision will be modified to make it enforceable to the maximum extent possible so as to effect the original intent of the parties, and the remaining provisions of this Covenant will continue in full force and effect.

9.3 No Waiver

Our failure to exercise or enforce any right or provision of this Covenant will not constitute a waiver of such right or provision.

9.4 Assignment

You may not assign or transfer any of your rights or obligations under this Covenant without our prior written consent. We are entitled to assign any or all of our rights and obligations under this Covenant to any third party of our choosing without notice to you.

9.5 Force Majeure

We shall not be liable for any failure to perform or delay in performance of our obligations due to causes beyond our reasonable control, such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

9.6 Entire Agreement

This Covenant, together with our Privacy Policy, constitutes the entire agreement between you and NORHEN LIMITED regarding our Services and supersedes all prior oral or written agreements between the parties on this subject.
